This bill would add a definition of "inherently beneficial use" to the "Municipal Land Use Law". If a use is held to be inherently beneficial, it presumptively satisfies the positive criteria for the grant of a use variance under existing law, which is required when the proposed use is inconsistent with the zoning plan.
The bill defines an "inherently beneficial use" as "a use which is universally considered of value to the community because it fundamentally serves the public good and promotes the general welfare. Such a use includes, but is not limited to, a hospital, school, child care center, group home, or a wind, solar or photovoltaic energy facility."

This bill, entitled the "New Jersey Economic Stimulus Act of 2009," attempts to reinvigorate New Jersey's economy through (1) an Economic Redevelopment and Growth Grant program, (2) authorization for certain municipalities to impose special taxes and surcharges to fund redevelopment activities and certain programs, (3) expansion of eligibility and tax credit limits under the "Urban Transit Hub Tax Credit Act," (4) relief to certain developers otherwise subject to the "Statewide Non-Residential Fee Act," (4) grants to municipalities for affordable housing, and (5) changes to improve the financing and fiscal management of higher education in New Jersey.

This bill would promote energy efficiency and conservation in buildings by authorizing the Commissioner of Community Affairs ("commissioner") to amend the Uniform Construction Code's energy subcode to establish enhanced energy-saving construction requirements, the added cost of which may reasonably be expected to be recovered through energy conservation over a period of not more than seven years.

This bill requires the Board of Public Utilities to adopt regulations providing that the prevailing wage rate determined by the Commissioner of Labor and Workforce Development be paid to workers employed in the performance of any construction undertaken in connection with board financial assistance, or undertaken to fulfill any condition of receiving board financial assistance, including the performance of any contract to construct, renovate or otherwise prepare a facility, the operations of which are necessary for the receipt of board financial assistance.

This bill would allow a person who owns preserved farmland to construct, install, and operate solar or wind energy facilities and equipment on the farm, whether on the preserved portion of the farm or on any portion excluded from preservation, for the purpose of generating power or heat, and to make improvements to any agricultural, residential, or other building or structure on the land for that purpose, provided that the solar or wind energy generation facilities and equipment.
